Terms of Service

​THIS AGREEMENT GOVERNS CUSTOMER’S ACQUISITION AND USE OF INSTANTDMARC’S SERVICES. ​By accepting this Agreement, by (1) clicking a box or button indicating acceptance, (2) accessing the platform, scanning a domain, or otherwise using the Services, Customer agrees to be bound by the terms of this Agreement.

​1. Definitions

​“Authorized User” means Customer’s employees or contractors permitted to use the Services. ​“Customer Data” means data submitted by or on behalf of Customer to the Services (e.g., domain names, email metadata). ​“Services” means the hosted SaaS platform provided by InstantDMARC, including automated 1-click DMARC, SPF, and TLS-RPT setup and management tools. ​“One-Time Service” refers to the per-domain or per-bundle flat fee model where the Service is fulfilled upon successful DNS configuration.

​2. License and Use

​2.1 License

InstantDMARC grants Customer a revocable, non-exclusive, non-transferable, limited right to access and use the Services for the purpose of securing Customer’s domains. ​

2.2 DNS Management Authority

By using the "1-click" setup features, Customer expressly authorizes InstantDMARC to act as an agent to interface with Customer’s DNS provider (via API or Domain Connect) to create, modify, or delete TXT and CNAME records specifically required for SPF, DMARC, and TLS-RPT compliance.

​2.3 Access Restrictions

Customer shall not reverse engineer the 1-click automation logic or use the Services to scan or modify domains for which they do not have explicit legal authorization.

​3. Payment, Billing, and Currency

​3.1 One-Time Fees

The Services are provided on a one-time fee basis per domain or package. All Fees are stated in the currency applicable to Customer’s region: USD for US and global customers; EUR for EU customers.

​3.2 Currency Conversion (ECB)

For payments made in EUR, the conversion from USD follows the European Central Bank (ECB) reference rate applicable on the date of the invoice or transaction. InstantDMARC may round to the nearest €5 or €10 for administrative consistency.

3.3 No Refunds

Because the Service involves immediate automated DNS configuration and resource allocation, all payments are non-refundable once the 1-click setup process has been initiated.

​4. Order of Precedence

​If any conflict arises between documents, the following precedence applies: (1) Invoiced terms; (2) Data Processing Addendum (DPA); (3) this Agreement.

​5. Confidentiality and Privacy

​Each party will protect the other’s non-public information with reasonable care. InstantDMARC’s use of personal data is governed by our Privacy Policy and Data Processing Addendum (DPA).

​6. Security and DNS Risks

​InstantDMARC maintains technical measures aligned with industry standards. While InstantDMARC automates security records, Customer acknowledges that manual alterations to DNS records outside the platform may break the 1-click configuration. InstantDMARC is not responsible for deliverability issues caused by third-party DNS provider outages.

​7. Warranties and Disclaimers

​7.1 Limited Warranty

InstantDMARC warrants that the 1-click automation will correctly attempt to inject the required DNS records into the Customer's DNS provider as specified in the service documentation.

7.2 Disclaimer

EXCEPT AS STATED ABOVE, THE SERVICES ARE PROVIDED “AS IS.” WE DO NOT GUARANTEE 100% PREVENTION OF EMAIL SPOOFING, AS SECURITY DEPENDS ON THIRD-PARTY RECEIVING SERVERS’ ADHERENCE TO DMARC POLICIES.

​8. Limitation of Liability

​Each party’s aggregate liability under this Agreement will not exceed the total Fees paid by Customer for the specific Service in question. InstantDMARC is not liable for indirect, incidental, or consequential damages (such as loss of profits or business interruption).

​9. Publicity

​Unless Customer opts out by emailing support@instantdmarc.com, InstantDMARC may use Customer’s name and logo on its website and marketing materials to identify them as a customer.

10. Governing Law

​This Agreement is governed by the laws of the State of Delaware, USA.
